Former Bundaberg surgeon Jayant Patel could walk free on bail as early as Friday night but the crown is yet to decide whether to pursue a retrial on his manslaughter charges.

Dr Patel was granted bail following the High Court's decision to quash his convictions on the grounds there was a miscarriage of justice during his trial.

He was sentenced to seven years' jail in July 2010 after a Brisbane Supreme Court jury found him guilty of the manslaughter of Gerry Kemps, 77, James Phillips, 46, and Mervyn Morris, 75.

He was also found guilty of causing grievous bodily harm to Ian Rodney Vowles, 62, during his time at Bundaberg Base Hospital between March 2003 and April 2005.

The High Court on Friday found the prosecution, on day 43 of the trial, radically changed its case in a way that rendered irrelevant much of the evidence that had been admitted. Read More
